Loyalty Rocks Club – Terms & Conditions

Carnival Cruise Line UK booking incentive scheme is about recognising and rewarding travel agents who deliver the best results.

ELIGIBILITY

This scheme is open to UK Travel Agents who are ABTA/ATOL bonded who reside in the UK, who are 18 years of age or older at the time of entry and who have agreed to participate in the Incentive Scheme and who have agreed to performance related points for the duration of the Incentive Scheme.

TO PARTICIPATE

To participate in the scheme and to remain a Participant in the incentive scheme, Travel Agents must:

Accept the Terms and Conditions of the incentive scheme on first log-in to the Incentive Scheme website.

At all times remain a UK Travel Agent who is ABTA/ATOL bonded. For the avoidance of doubt, Carnival Cruise Line shall have no liability to Travel Agents where, for whatever reason, the Travel Agent leaves the employment of their Travel Agency. In such circumstances Carnival Cruise Line shall suspend such Travel Agent’s account. Carnival Cruise Line will however permit the user to utilise any points accrued up to that time in accordance with the terms of the incentive scheme until month close.

It is the Travel Agents responsibility to keep passwords and username details secret. Carnival Cruise Line shall accept no responsibility for any loss suffered by the Travel Agent where such loss is attributed to a failure by a Travel Agent to maintain account security.

Carnival Cruise Line will announce the activities and targets that Travel Agents are required to achieve to earn points.

These activities and targets may vary by product/resource.

TIMING

The scheme runs from 1st December 2016 and, unless otherwise stipulated, will be on-going.

Participation in the Incentive Scheme constitutes full and unconditional acceptance of these Terms and Conditions. Carnival Cruise Line reserves the right to disqualify anyone in breach of these terms and conditions.

USE OF DATA

Personal data which you provide will be shared with Motivates Ltd to fulfil the rewards and will not be used for any other purpose unless agreed. It may be used for programme communications and for the purpose of the Travel Agent Incentive programme only.

POINTS

Once a claim has been submitted it will be reviewed every two weeks and approved or declined. 

AWARDING POINTS

Points will be awarded to the Travel Agent once a claim has been approved at the end of the week.

Points will only be awarded to the Travel Agent once they have submitted their claim with all the correct details.

Travel Agents will have the opportunity to boost their earnings through our online training CCLU points will be allocated to the Travel Agent directly to their account.

Carnival Cruise Line reserves the rights to increase or decrease points awarded through the incentive scheme without notice including Carnival Cruise Line University.

The claim must be submitted by the end of each month in order for the correct points to be awarded.

Carnival Cruise Line reserves the right to increase or decrease time allocated to claim bookings through the scheme.

REDEEMING POINTS

Points must be redeemed via the website. Prizes once chosen can only be changed if the redeemer contacts within 24 hours of the redemption.

Substitution

In case of a reward item not being available, we will contact the user within 7 days of placing the order and offer a replacement item of similar value. If the user does not wish to accept the replacement item, the original value of the reward deducted from the user’s account will be re-credited.

Motivates Limited Inc reserves the right to substitute prizes of equal or similar value.

Motivates ​Limited Inc reserves the right to remove or include any reward from the range at our discretion.

Motivates ​Limited Inc will honour any rewards that have already been allocated a Travel Agent prior to any website alterations.

Delivery

The delivery of Lifestyle and Special Offers will be via an instant e-voucher and gifts will be posted within 15 working days.

The delivery of all Lifestyle and Special Offers will be made to the email address as supplied by the user at the time of order.

Validity

Lifestyle vouchers are valid for two years from date of purchase. The exact expiry date will be printed on the e-voucher or advised upon successful activation. You must use the voucher before this expiry date or it will no longer be valid.

Returns

The Travel Agent acknowledges that lifestyle vouchers are not returnable and non-refundable

Tax and National Insurance

Prizes and rewards are considered a taxable benefit to the recipients. While Carnival Cruise Line will cover the National Insurance on this award, it remains taxable in the hands of the individual. Therefore, you will have an income tax liability which remains your responsibility.

OTHER

Prizes and rewards may be considered a taxable benefit to the recipients. Carnival Cruise Line may agree to pay the tax liability and National Insurance contributions arsing on behalf of the Travel Agent. Where it does not, recipients will be informed and will be directly responsible for accounting for and paying to their local tax offices any tax liability and NI contributions arising on their prize. Motivates ​Limited Inc will not account for any social or National Insurance or tax liability arising from this promotion.

Carnival Cruise Line and Motivates ​Limited Inc will absolve themselves from any liability arising from any National Insurance contributions arising from this prize.

No correspondence will be entered into regarding either this scheme or these Terms and Conditions. In the unlikely event of a dispute, Carnival Cruise Line’s decision is final. Carnival Cruise Line and/or Motivates ​Limited Inc reserve the right to amend, modify, cancel or withdraw this scheme at any time without notice.

Carnival Cruise Line and/or Motivates ​Limited Inc cannot guarantee the performance of any third party and shall not be liable for any act or default by a third party. Travel Agents in this incentive scheme agree that Carnival Cruise Line and Motivates ​Limited Inc will have no liability whatsoever for any injuries, losses, costs, damage or disappointment of any kind resulting in whole or in part, directly or indirectly from acceptance, misuse or use of a prize, or from participation in this promotion. Nothing in this clause shall limit Carnival Cruise Line or Motivates ​Limited Inc liability in respect of death or personal injury arising out of its own negligence or arising out of fraud.

Carnival Cruise Line or Motivates ​Limited Inc reserves the right in its sole discretion to cancel or suspend the redemption programme.

ACCOUNT DELETION

   Requesting Account Deletion

  • End users have the right to request the deletion of their account at any time from the Loyalty Rocks Club. To initiate the account deletion process, users must contact our support team at [email protected].
  • Upon receiving a deletion request, we will take reasonable steps to verify the identity of the user to ensure that the request is legitimate.

   Processing Time

  • Account deletion requests will be processed within 2 business days of receiving the request. During this period, the user may be contacted to confirm the deletion request or to provide further information if needed.
  • Users are advised that certain data may be retained for a limited period following deletion for purposes such as legal compliance, fraud prevention, and dispute resolution, as permitted by applicable laws.

   Consequences of Deletion

  • Upon the successful deletion of an account, all personal data, including user content and account information, will be permanently removed from our active databases. However, data may persist in backup or archival copies for a reasonable period as required by law.
  • Deleting an account is irreversible. Once deleted, the user will lose access to all incentives, rewards, or other benefits associated with the account. Any outstanding or unredeemed rewards will be forfeited.

   Data Retention Obligations

  • We reserve the right to retain certain information as required by law or for legitimate business purposes, even after an account has been deleted. Such information may include transaction records, communication logs, and any data necessary to comply with our legal, regulatory, or audit obligations.

   Reactivation of Deleted Accounts

  • Once an account is deleted, it cannot be reactivated or restored. Users wishing to use our services again will need to create a new account, subject to our then-current Terms & Conditions.


Data Protection

Motivates ​Limited Inc complies with each of the eight principles of the Data Protection Act 1998. Those principles require that data is:

  • fairly and lawfully processed
  • processed for limited purposes
  • adequate, relevant and not excessive
  • accurate
  • not kept longer than necessary 
  • processed in accordance with the data subject’s rights
  • secure
  • not transferred outside the EU without adequate protection

The text, illustrations and images used in all Motivates ​Limited Inc promotional materials are protected by copyright and must not be copied in whole or in part without the express permission of Motivates ​Limited Inc

All the above terms and conditions apply as a condition of using any voucher, whether or not the voucher holder is the original purchaser. Motivates ​Limited Inc reserves the right to change these terms from time to time without reference to customers. These terms and conditions do not affect your statutory rights as a consumer, and are governed by and in accordance with English law. The purchaser and Motivates ​Limited Inc agree that any problems fall under the jurisdiction of the English courts.
